My condolences to you, and I know this may be an emotional time for you. First, I would strongly suggest trying to locate any and all documentation you can find relating to that person's final wishes, which are typically in the form of a Will or Trust. With any luck, your loved one will have had an open conversation with you about their final wishes and shared with you any documentation they put in place to that regard -- though that is not always the case. The types of documentation you locate will likely dictate what you need to do next. And remember: just because you may be an heir to this estate, that doesn’t necessarily mean you’re a decision maker when it comes to selling any real estate. Questions? When a loved one passes away and they convey their final wishes via a Last Will & Testament or an equivalent document (or leave no instructions), there are steps to take to settle the estate and sell any real estate property owned by person who passed away. Here’s a general outline of the initial steps to take...

Locate Any and All Documentation You Can Find Relating to the Final Wishes of the Deceased and their Financial Affairs. Consult Professionals if Needed. 

Obtain the Death Certificate.

Did I mention talk to an Attorney? 

If Necessary, File for Probate. 

If the deceased owned any real estate, is there valid insurance on the property?

Follow the Steps of Probate. 

Obtain a Taxpayer ID Number.

Keep Records. Manage and Distribute Assets.
